Section 3 provides far the precedence of the members f

the Bench.

Section 4 prescribes the effect of a judgement in cases

in which there is any difference in spinion amongst the mem-

bers of the Court:

it provides that where 3 Judges are sitting the judge-

ment of the majority shall prevail:

it provides that where 2 Judges sit on an appeal the

decision appealed from shall in the case of difference in

●pinion not be disturbed;

it also provides that in the case of 2 Judges exercising

ther than appellate jurisdiction the opinion of the Senior

of the 2 Judges shall in case they differ prevail subject to

an appeal to a Rench of 3 Judges.

Section 5 provides in all cases specified in subsection that 1 the Full Court shall be composed of 2 Judges and in sub-

A section 2 for an addition in all other cases to the Bench of

an additional Supreme Court Judge in manner indicated therein.

Section 6 and the Schedule deal with certain small

amendments in the existing law which are necessitiated by the

passage of this Ordinance.

Section 7 fixes the 1st. day of December 1912 as the

date on which the Ordinance shall come inte speration.

5. In my opinion the Ordinance is one to which His

Excellency the Governer may properly assent in the name of

His Majesty and on His behalf.
